CaseChat Overview and Summary
The key legal issues before the Deputy President were whether the agreement met the statutory requirements for approval and if the prescribed flexibility term was incorporated. Additionally, the court needed to confirm that the agreement was intended to cover the organisation and its members as declared by the AWU. The Deputy President had to review the application, the statutory declaration, and the terms of the agreement to determine if all legislative criteria were satisfied.
After reviewing the application and the statutory declaration, the Deputy President concluded that the agreement fulfilled all relevant requirements of the Fair Work Act. The model flexibility term was considered to be part of the agreement as per the Fair Work Regulations. The AWU's declaration that the agreement should cover its members was also accepted. Consequently, the Deputy President approved the agreement. The approval was issued on 24 February 2016, and the agreement was set to operate from 2 March 2016, with a nominal expiry date of 6 December 2018.
