Woley and Humboldt (Discovery)

In the matter of *Woley and Humboldt (Discovery)*, Chief Justice Bryant considered a dispute concerning the discovery of documents between a husband and wife. The wife sought specific documents from the husband, which he had resisted providing.

The central legal issue before the court was whether the husband was obliged to produce the requested documents, which related to a UBS account held in his personal name and financial records of SN Management Pty Ltd in its capacity as manager of the NTrusts Partnership, as well as certain tax-related documents.

The Chief Justice ordered the husband to provide the wife with copies of statements for the UBS account from its opening in July 1989 to 30 June 2003. Additionally, the husband was required to produce the general ledger of SN Management Pty Ltd, in its role as manager of the NTrusts Partnership, from 1 July 1989 (or the earliest available date) to 30 June 2006. Finally, the husband was ordered to provide copies of "Notice of Test Individual" documents lodged with the ATO for specified non-admitted entities, as requested by Mr F from Mr V during a meeting on 29 September 2008. These documents were to be provided by 4.00pm on 18 December 2008, or as soon thereafter as practicable.
