Windle & Elms

In the matter of *Windle and Elms*, heard by Baumann J, the father, Mr Elms, sought orders for sole parental responsibility and that the child live with him. The mother, Ms Windle, was reportedly involved in ongoing criminal proceedings and had disengaged from the parenting proceedings.

The court was required to determine whether to grant the father's application for sole parental responsibility and for the child to live with him, given the mother's disengagement and alleged criminal involvement.

Baumann J made orders on an undefended basis, granting the father sole parental responsibility for the child and ordering that the child live with the father. The court also ordered that the child spend time and communicate with the mother at all reasonable times as may be agreed in writing between the parents. The Independent Children's Lawyer was discharged.
