Willham and Terr

In *Willham and Terr*, Bell J of the Family Court of Australia considered a dispute between a father and mother concerning costs.

The primary legal issue before the Court was the appropriate basis upon which the father should be ordered to pay the mother's costs.

Bell J ordered that the father pay the costs of the mother, to be assessed on a standard basis up to 16 December 2009. Thereafter, the father was ordered to pay all costs of the mother on an indemnity basis.
