CaseChat Overview and Summary
The legal issues before the Commission were whether the agreement provided for appropriate employee representation and consultation, the adequacy of the processes followed in negotiating the agreement, and whether the agreement satisfied the good faith bargaining requirement. The Commission needed to determine if the agreement was genuinely negotiated and if it provided fair and reasonable terms and conditions for the employees.
The Commission reviewed the evidence and submissions presented by both parties. It considered the procedural fairness of the negotiation process and whether the agreement was negotiated in good faith. The Commission concluded that the agreement met the necessary requirements for approval, including the appropriate representation and consultation of employees, and that the negotiation process was fair and genuine. The Commission approved the Wild Energy Enterprise Agreement 2015, recognising it as meeting the legal standards under the Fair Work Act 2009.
The Fair Work Commission's decision was to approve the Wild Energy Enterprise Agreement 2015, acknowledging that it provided fair and reasonable terms and conditions for the employees and that the negotiation process was conducted in good faith and with procedural fairness.
