White and Andrews

In the matter of *White and Andrews*, heard before Dessau J, the dispute concerned an application by the mother, Ms White, for the release of her child's passport to facilitate a trip to Europe. The father, Mr Andrews, was also a party to the proceedings.

The primary legal issue before the Court was whether to grant the mother's application for the release of the child's passport for the proposed European trip. A secondary issue arose regarding the father's weekend time with the child, which was impacted by the proposed travel dates.

Dessau J reasoned that the child's passport should be released to the mother for the specified travel period, from 5 September 2011 to 9 October 2011. To compensate for the father's lost weekend time on 16-18 September 2011, the Court ordered that the father would instead spend time with the child on the weekend of 26-28 August 2011. The Court also made provisions for the service of these orders on the father and granted him leave to apply to set aside the orders within 14 days of service. The mother's application was otherwise dismissed.
