WETHERALL (DECEASED) & WETHERALL

This matter concerned an application by the deceased, Mr Wetherall, and Mrs Wetherall, concerning their child, J. The proceedings were heard by Bell J in the Family Court of Australia.

The primary legal issues before the Court were whether the deceased, Mr Wetherall, should have sole parental responsibility for the child J, and the appropriate orders to be made in light of the deceased's passing.

Bell J considered the existing orders made by Justice O’Reilly on 6 December 2010, which had previously addressed parental responsibility. In light of the death of Mr Wetherall, the Court determined that the application for sole parental responsibility by the deceased could not proceed. The Court instead made orders reflecting the current circumstances, granting sole parental responsibility to Mrs Wetherall.

Consequently, the Court dismissed the application filed on 22 July 2009, discharged Order 1 of the previous orders, and dismissed all other outstanding applications, removing the matter from the Pending Cases List.
