CaseChat Overview and Summary
The legal issues addressed in the case revolved around whether the application met all the necessary requirements for approval under sections 186, 187, and 188 of the Act. Specifically, the court needed to determine if the agreement was made in good faith, was in writing, and if it had been appropriately certified by the relevant bargaining representative.
Commissioner Roe concluded that the application satisfied all the relevant requirements under sections 186, 187, and 188 of the Act. The Agreement was thus approved on 11 February 2016, effective from 18 February 2016. The nominal expiry date of the Agreement is set for 11 February 2020.
