CaseChat Overview and Summary

In the matter of *West and Morris*, O'Ryan J of the Family Court of Australia considered applications by both the husband and the wife. The husband sought a review of urgent maintenance orders made on 9 October 2007. The wife had filed applications for costs and interim spouse maintenance, as well as for a departure from an administrative assessment of child support payable by the husband.

The court was required to determine whether to uphold the urgent maintenance orders made against the husband, and to set future hearing dates for the wife's applications concerning interim spouse maintenance, child support departure, and costs. The court also needed to consider the listing of any further applications for final orders.

O'Ryan J dismissed the husband's applications for a review of the urgent maintenance orders. The court then vacated the existing return dates for the wife's applications concerning costs, interim spouse maintenance, and departure from child support assessment, and relisted these matters before the Judicial Registrar on 25 February 2008. Furthermore, any further applications for final orders filed on or before 25 February 2008 were also to be listed before the Judicial Registrar on that date. The parties were directed to file a costs memorandum in accordance with the Family Law Rules on 25 February 2008.
