Weng and Wah and Ors

This matter concerned financial adjustment proceedings between a husband and wife, with the son of the parties also involved in the dispute. The proceedings before Forrest J of the Federal Circuit and Family Court of Australia, Family Law Division, involved the division of property and the resolution of claims concerning various companies and trusts.

The court was required to determine the appropriate distribution of assets and liabilities between the husband and wife, including interests in companies, real property, superannuation, and debts owed by family trusts. Additionally, the court had to consider applications made by the husband against the son, his companies, and trusts, as well as applications by the wife and son against companies associated with the husband. The court also had to address the wife's application for the reinstatement of caveats.

Forrest J ordered that the husband would retain specific properties in China and Victoria, as well as his interests in K Pty Ltd and L Pty Ltd, and his superannuation. The husband was also to receive funds held in trust by T Lawyers. The wife was assigned any debt owed to her and/or the husband by the Mr C Weng Family Trust, and she was to retain her interests in G Pty Ltd and Q Business, along with any other companies she controlled. The husband's applications against the son and his entities were dismissed, as were the wife's and son's applications against K Pty Ltd and L Pty Ltd. The wife's application for the reinstatement of caveats was also dismissed. Finally, the court directed that copies of the reasons for judgment and relevant affidavits be forwarded to the Commissioner of the Australian Taxation Office for consideration regarding unpaid tax debts.
