CaseChat Overview and Summary
The legal issues before the Commission involved assessing the fairness and reasonableness of various terms within the proposed agreement. These terms included provisions related to wages, hours of work, leave entitlements, and other conditions of employment. The Commission had to determine whether the agreement provided a fair and reasonable balance between the interests of the employer and employees. Additionally, it had to consider whether the agreement complied with any relevant awards or other industrial instruments and whether it adhered to the provisions of the Fair Work Act.
The Fair Work Commission found that the proposed Enterprise Agreement was fair and reasonable. The Commission was satisfied that the agreement provided for adequate wage rates, reasonable hours of work, and appropriate leave entitlements. Furthermore, it was found to be compliant with any relevant industrial instruments and adhered to the provisions of the Fair Work Act. Consequently, the Commission approved the WAY Electrical Pty Ltd Enterprise Agreement 2022.
