Watkins v Combes

The appeal concerned a suit brought in the Supreme Court of Tasmania by Algernon James Combes and Arundel Sims against Daniel Watkins, his wife Ellen Margaret Watkins, and the executors named in an earlier will, David Saunders and Percy Rutherford Henry. The plaintiffs, beneficiaries under two wills made by Laura Josephine Reynolds, sought declarations that a transfer of land by the deceased to the Watkins and the appointment of Daniel Watkins as executor were procured by fraud and undue influence, and were therefore void. They also sought an injunction and the appointment of a receiver for the deceased's estate.

The central legal issue before the High Court was whether the Supreme Court of Tasmania, in its equitable jurisdiction, possessed the power to entertain the suit and grant the relief sought, given that probate of the deceased's will had not yet been granted. The appellants argued that without a grant of probate, the plaintiffs lacked a cause of action and the necessary interest to seek equitable relief concerning the land transfer or the executor's appointment.

The High Court, in allowing the appeal and dismissing the suit, held that a suit in equity would not lie by a beneficiary against a named executor for a declaration that a transfer of land or the appointment of the executor was procured by fraud, where probate had not yet been granted. The Court found a fatal defect in the parties' standing to bring such a claim in equity prior to the formal grant of probate. Consequently, the decree made by the Supreme Court of Tasmania was reversed.
