CaseChat Overview and Summary

This case concerned parenting orders made by Judge Brown in relation to the children X and Y. The dispute between the parents, Ms Warren and Mr Crawford, was significant, stemming from their differing parenting values, personalities, and a struggle for advantage over each other, which made agreement on important matters for the children's care and development extremely difficult.

The court was required to determine the appropriate orders for parental responsibility, living arrangements, and time spent with each parent for the children, X and Y, who both had special needs. Key issues included the father's sole parental responsibility for school enrolment decisions, the specific living arrangements and holiday schedules, the provision of financial support, and the potential impact of any changes on the children, particularly X, who was not likely to cope well with change. The court also considered the parents' past involvement in decision-making, their attitudes towards parental responsibilities, and the potential for future proceedings.

Judge Brown reasoned that while both parents aspired to be good parents, Mr Crawford had demonstrated a more consistent and responsible discharge of parental duties, particularly since 2010 when the children came into his predominant care. The court noted Mr Crawford's financial support for the children, especially given their special needs, and found his actions credible. Conversely, Ms Warren's past parenting difficulties, including having two sets of children removed from her care, were acknowledged, although the court noted that her older children had since returned to her. The court was not convinced that Ms Warren's parenting had been subject to the same degree of scrutiny as Mr Crawford's. The judge emphasised the need to avoid experimental arrangements and acknowledged that X, in particular, would struggle with significant changes.

The court made orders for equal shared parental responsibility, with specific exceptions for school enrolment decisions. The children were to live with the father nine nights per fortnight and the mother five nights per fortnight, with detailed arrangements for school holidays, Christmas, Easter, and birthdays. Injunctions were granted restraining both parents from abusing or denigrating the other in the presence of the children, or from physically or verbally abusing the children. All applications were dismissed.
