Warrell and Secretary, Department of Social Services (Social services second review)

This matter concerned an appeal by the applicant, Ms Warrell, against a decision by the Secretary of the Department of Social Services to recover the quantum of an age pension as a debt. The applicant sought to argue that a preclusion period should not apply, or that special circumstances existed that would allow part or all of a compensation payment to be treated as not having been made, or that special circumstances made it desirable to waive the debt. The Administrative Appeals Tribunal was required to consider these arguments.

The Tribunal was tasked with determining whether the applicant had established special circumstances that would justify treating the compensation payment as not having been made for the purposes of calculating the age pension, or alternatively, whether special circumstances warranted the waiver of the debt. The core legal issue revolved around the interpretation and application of the relevant provisions of the social security legislation concerning compensation payments and the recovery of overpayments.

The Tribunal found that a constellation of factors constituted special circumstances. Consequently, it determined that for the purposes of section 1184K of the relevant legislation, the whole of the compensation payment was to be treated as not having been made. The Tribunal set aside the decision under review and remitted the matter to the Respondent. The Respondent was directed to reconsider whether, in any recalculations arising from this determination, payments were made to the applicant at the appropriate rate in all the circumstances.
