CaseChat Overview and Summary

This matter concerned an appeal by a visa applicant against the refusal of their Partner (Provisional) (Class UF) (Subclass 309) Visa. The visa applicant claimed to be in a spousal relationship with an Australian citizen, Anna Xue Wang, who lodged a sponsorship application in support. The parties met in March 2015, committed to each other in October 2015, became engaged in January 2016, and married on 10 March 2016, shortly before the visa application was lodged. The delegate refused the application on 7 November 2016. The Tribunal, presided over by Senior Member Justin Owen, considered all evidence presented, including departmental and tribunal files, and oral evidence from both parties.

The primary legal issue before the Tribunal was whether the visa applicant and the sponsor were in a genuine and continuing spousal relationship, as required by clauses 309.211(2) and 309.221 of the Migration Regulations 1994. This required determining if the parties met the definition of a married relationship under section 5F of the Migration Act 1958, which necessitates a valid marriage, a mutual commitment to a shared life to the exclusion of others, a genuine and continuing relationship, and cohabitation or not living separately and apart on a permanent basis. The Tribunal was required to consider all circumstances of the relationship, including financial, social, household, and commitment aspects, as outlined in regulation 1.15A(3).

The Tribunal found that the parties were validly married, satisfying section 5F(2)(a) of the Act. However, the Tribunal concluded that the other requirements for a spousal relationship were not met. Despite the marriage, the Tribunal was not satisfied that there was a mutual commitment to a shared life to the exclusion of all others, that the relationship was genuine and continuing, or that the parties lived together or did not live separately and apart on a permanent basis. The Tribunal affirmed the delegate's decision not to grant the visa.
