CaseChat Overview and Summary
The key legal issues before the Commission were whether the agreement was made genuinely and in good faith, and if it provided fair and reasonable terms of employment. The Transport Workers Union contested the agreement, claiming it did not meet the standards required under the Fair Work Act 2009. The company argued that the agreement was genuinely negotiated and provided fair terms for the employees.
The Commission examined the evidence and submissions from both parties, taking into consideration the principles of genuine negotiation and fairness in the making of the agreement. The Commission found that the agreement was genuinely negotiated and met the requirements of the Act. The terms and conditions of employment were considered fair and reasonable, taking into account the economic climate and the nature of the industry. The Commission approved the Walker OGR Enterprise Agreement 2015, dismissing the union's objections.
