The court emphasised that the procedural protections afforded by the Act are fundamental to ensuring that native title rights are respected and that future acts affecting them are conducted lawfully.

The court ordered that the respondents be restrained from proceeding with the sale of the land until they had complied with their obligations under the *Native Title Act 1993* (Cth).
