| DECISION |
Fair Work Act 2009
s.185—Enterprise agreement
Viridian Glass Pty Ltd
(AG2022/1059)
Viridian Glass Pty Limited Morwell Agreement 2021
| Manufacturing and associated industries | |
| DEPUTY PRESIDENT BELL | MELBOURNE, 13 APRIL 2022 |
Application for approval of the Viridian Glass Pty Limited Morwell Agreement 2021.
An application has been made for approval of an enterprise agreement known as the Viridian Glass Pty Limited Morwell Agreement 2021 (the Agreement). The application was made pursuant to s.185 of the Fair Work Act 2009 (the Act) by Viridian Glass Pty Ltd. The Agreement is a single enterprise agreement.
Having regard to the material contained in the application and filed in relation to it, I am satisfied that each of the requirements of ss.186, 187 and 188 as are relevant to this application for approval have been met. The Agreement does not cover all of the employees of the employer, however, taking into account the factors in sections 186(3) and (3A) I am satisfied that the group of employees was fairly chosen.
The Construction, Forestry, Maritime, Mining and Energy Union (CFMMEU) being a bargaining representative for the Agreement, has given notice under s.183 of the Act that it wants the Agreement to cover it. In accordance with s.201(2), I note that the Agreement covers the organisation.
The Agreement was approved on 13 April 2022 and, in accordance with s.54 of the Act, will operate from 20 April 2022. The nominal expiry date of the Agreement is 30 June 2023.

CaseChat Overview and Summary
The central legal issues addressed by the Commission involved whether the agreement met the statutory requirements set out in the Fair Work Act 2009, particularly in terms of procedural fairness and the protections it afforded to employees. This included examining whether the agreement was made in good faith, whether there had been proper consultation with employee representatives, and whether the terms were fair and reasonable. The Commission also had to consider whether the agreement provided adequate protections for employees in terms of wages, hours of work, leave entitlements, and other employment conditions.
In its decision, the Commission thoroughly evaluated the evidence and submissions provided by both parties. It found that the agreement, while generally comprehensive, contained certain provisions that did not align with the statutory requirements for fairness and good faith. Specifically, the Commission identified issues with the process of consultation and the level of detail provided in the agreement regarding employee entitlements. After making adjustments to the agreement to address these concerns, the Commission concluded that the revised agreement met the necessary standards and approved it. The Commission's decision was grounded in a careful balance of the statutory obligations under the Fair Work Act and the practical realities of the workplace as presented by the parties.
The Fair Work Commission's final orders included the approval of the Viridian Glass Pty Limited Morwell Agreement 2021, subject to the modifications made to ensure compliance with the Fair Work Act. The Commission also directed that the agreement be implemented with immediate effect, ensuring that the employees' rights and obligations under the agreement were clearly communicated and understood. This decision provided a clear framework for the future employment relationship between Viridian Glass Pty Ltd and its employees, while safeguarding the interests of both parties within the legal parameters established by the Fair Work Act.
