CaseChat Overview and Summary
The legal issues before the Commission included whether the proposed changes in the agreement were procedurally fair, whether they provided adequate protection for the employees, and whether they complied with the provisions of the Fair Work Act 2009. Additionally, the Commission needed to assess if the agreement met the standard criteria for approval, including whether it provided for a fair and efficient workplace and whether it was the product of genuine bargaining.
The Fair Work Commission concluded that the VIP Packaging Agreement 2013 was procedurally fair and provided adequate protections for the employees. The Commission found that the changes were necessary to improve the efficiency of the workplace and that the agreement was the result of genuine bargaining between the employer and the employees. The Commission determined that the agreement met the criteria for approval and was in the best interests of the employees. The application for approval of the VIP Packaging Agreement 2013 was subsequently approved.
