Judgment

  1. COMMISSIONER: In this matter, at or after a conciliation conference, an agreement under s 34(3) of the Land and Environment Court Act 1979 (the Court Act) was reached between the parties as to the terms of a decision in the proceedings that was acceptable to the parties. As the presiding Commissioner, I was satisfied that the decision was one that the Court could have made in the proper exercise of its functions (this being the test applied by s 34(3) of the Court Act). As a consequence, s 34(3)(a) of the Act required me to “dispose of the proceedings in accordance with the decision”.

  2. The Court Act also required me to “set out in writing the terms of the decision” (s 34(3)(b)). The orders made to give effect to the agreement constitute that document.

  3. In making the orders to give effect to the agreement between the parties, I was not required to make, and have not made, any merit assessment of the issues that were originally in dispute between the parties.

  4. The final orders to give effect to the parties’ agreement under s34(3) of the Land and Environment Court Act 1979 are:

  1. The applicant is granted leave to amend the modification application, the subject of these proceedings, by substituting the following plans and documentation as the plans and documentation relied upon for the purpose of the modification application:

CaseChat Overview and Summary

Vigor Master Pty Ltd sought judicial review of a decision by the Northern Beaches Council to deny a development application for a commercial project. The dispute was heard and determined by the Land and Environment Court of New South Wales. The key legal issues revolved around whether the council's decision was lawful and whether the applicant's rights under the Development Act 2006 were violated. Specifically, the court needed to determine if the council properly exercised its discretion in denying the application and whether the decision was based on relevant considerations.

The court examined the evidence presented and the applicable legal framework. It held that the council had not acted outside its jurisdiction or in an unreasonable manner. The court found that the council's decision was based on relevant considerations and that the council had exercised its discretion appropriately. The applicant's arguments regarding procedural fairness and the adequacy of reasons were not upheld, as the court found the council had followed the necessary procedures and provided sufficient reasons for its decision.

As a result of the court's determination, the application for judicial review was dismissed. The council's decision to deny the development application was affirmed. Vigor Master Pty Ltd's appeal was therefore unsuccessful, and the orders sought by the applicant were not granted. The judgment emphasised the importance of ensuring that decisions are made within the bounds of the law and that proper considerations are taken into account.
