VERGONYOS & SUREDA

In the matter of *Vergonyos & Sureda*, Judge Carter of the Federal Circuit Court of Australia considered an application for review of a Registrar's decision concerning a divorce order. The dispute arose when the Wife sought to challenge a divorce order made by the Registrar in relation to the marriage between Mr Vergonyos (the Husband) and Ms Sureda (the Wife), which was solemnised in 1981.

The primary legal issues before the Court were whether Australia was a clearly inappropriate forum for the divorce proceedings and whether the Registrar had jurisdiction to make the divorce order. The Wife also raised arguments concerning prejudice, which the Court needed to address in its determination.

Judge Carter reasoned that Australia was not a clearly inappropriate forum and that the jurisdiction requirements were satisfied. The Court found that the marriage was proved, the Husband was at all material times domiciled in Australia, and the marriage had broken down irretrievably. Consequently, the Court made a divorce order, to take effect on 23 June 2020. The Wife's response to the divorce and her subsequent applications for review and in a case were dismissed. The Wife was ordered to pay the Husband's costs fixed at $1,120 within 28 days.
