Verey v Andy's Earthworks Pty Ltd

Verey (the applicant) sought leave to appeal against a decision of the Full Federal Court, which had dismissed his appeal from a judgment of a single judge of the Federal Court. The dispute concerned the applicant's claim for damages for breach of contract and misleading or deceptive conduct against Andy's Earthworks Pty Ltd (the respondent). The applicant alleged that the respondent had failed to perform certain contractual obligations and had engaged in conduct that misled him regarding the performance of those obligations.

The High Court was required to determine whether the Full Federal Court had erred in its assessment of the evidence and its application of the law to the facts. The court affirmed that the findings of fact made by the primary judge, and upheld by the Full Federal Court, were not demonstrably wrong. The application for leave to appeal was therefore refused.
