CaseChat Overview and Summary

In the Fair Work Commission, Ventura Bus Lines Pty Ltd applied for approval of the Ventura Bus Lines P/L - Knoxfield Depot Enterprise Agreement 2022. The application was opposed by the Bus and Coach Workers Union of Australia, the Transport Workers Union of Australia, and the Rail, Tram and Bus Industry Union. The dispute centred around various provisions of the proposed enterprise agreement, including working hours, shift patterns, rostering processes, and other related matters. The court had to determine whether the proposed agreement met the statutory requirements for approval under the Fair Work Act 2009.

The legal issues primarily revolved around whether the agreement provided for fair and reasonable terms and conditions for employees, whether it complied with the procedural requirements set out in the Fair Work Act, and whether the agreement was made in good faith and without coercion. The court considered the arguments presented by both parties and examined the provisions of the agreement in detail. It also took into account the relevant principles and precedents established by previous cases and legislation.

After carefully considering the evidence and arguments, the court found that the proposed enterprise agreement met the statutory requirements for approval. The court was satisfied that the agreement provided for fair and reasonable terms and conditions for the employees and that it complied with the procedural requirements of the Fair Work Act. The court also determined that the agreement was made in good faith and without coercion. Consequently, the application for approval of the Ventura Bus Lines P/L - Knoxfield Depot Enterprise Agreement 2022 was approved.

The final orders included the approval of the Ventura Bus Lines P/L - Knoxfield Depot Enterprise Agreement 2022, effective from the date of the decision. The agreement was to be registered with the Fair Work Commission and would apply to the relevant employees covered by the agreement. The court's decision provided clarity and certainty for the parties involved, ensuring that the agreement would be implemented in accordance with the Fair Work Act and the principles of good faith and fairness.
