CaseChat Overview and Summary
The primary legal issues before the Commission were whether the agreement complied with the legislative requirements and if it appropriately balanced the interests of the employees and the employer. This involved scrutiny of the agreement's provisions concerning wages, hours of work, leave, and dispute resolution procedures. The Commission also considered the extent to which the agreement facilitated flexibility and productivity in the workplace.
The Commission determined that the enterprise agreement met the necessary criteria for approval. It found that the agreement contained provisions that provided for fair and reasonable wages and conditions, and that it included appropriate mechanisms for resolving disputes. The Commission was satisfied that the agreement achieved a fair balance between the interests of the employees and the employer, and that it would promote flexibility and productivity. The agreement was therefore approved under section 235 of the Fair Work Act 2009.
The Commission made an order approving the Ventia Utility Services (Sydney Water Trades and Apprentices) Enterprise Agreement 2015, effective from the date of the decision. This decision provides certainty for both Ventia Utility Services and its employees, ensuring that the agreement is legally binding and can be implemented in the workplace.
