CaseChat Overview and Summary

In this matter, the Transport Workers' Union of Australia sought an extension of the 30-day period for industrial action authorised by a protected action ballot, as declared on 6 March 2025. The application was brought under section 459(3) of the Fair Work Act 2009. The respondents, Star Track Express Pty Limited and Star Track Retail Pty Ltd Trading as Star Track, did not object to the application. The legal issue before the court was whether the union's application met the statutory requirements for an extension, specifically if the 30-day period had not been previously extended.

The court reviewed the application and found that all requirements for an extension were met. The union had applied to the Fair Work Commission for an extension within the permitted timeframe, and the 30-day period had not been extended before. Given these findings, the court concluded that the union's application should be granted. The decision was made in accordance with section 459(3) of the Act, extending the period for protected industrial action by a further 30 days, starting from 5 April 2025.
