CaseChat Overview and Summary

The Australian Rail, Tram and Bus Industry Union has applied to the Fair Work Commission for an extension of the 30-day period during which industrial action may be taken, as authorised by a protected action ballot. The application concerns the protected action ballot PR778869, which was declared on 17 September 2024, and the relevant employees are those employed by Metro Tasmania Pty Ltd. Metro Tasmania has indicated that it has no objections to the application. The legal question before the Deputy President was whether the requirements of section 459(3) of the Fair Work Act 2009 had been met, so as to justify an extension of the period during which protected industrial action may be taken. The Deputy President was satisfied that the requirements of section 459(3) had been met and that the period should be extended by a further 30 days. The Deputy President therefore ordered that the 30-day period be extended by a further 30 days, commencing on 4 October 2024.
