Judgment

  1. COMMISSIONER: In this matter, at or after a conciliation conference, an agreement under s 34(3) of the Land and Environment Court Act 1979 (the Court Act) was reached between the parties as to the terms of a decision in the proceedings that was acceptable to the parties. As the presiding Commissioner, I was satisfied that the decision was one that the Court could have made in the proper exercise of its functions (this being the test applied by s 34(3) of the Court Act). As a consequence, s 34(3)(a) of the Act required me to “dispose of the proceedings in accordance with the decision”.

  2. The Court Act also required me to “set out in writing the terms of the decision” (s 34(3)(b)). The orders made to give effect to the agreement constitute that document.

  3. In making the orders to give effect to the agreement between the parties, I was not required to make, and have not made, any merit assessment of the issues that were originally in dispute between the parties.

  4. The final orders to give effect to the parties’ agreement under s34(3) of the Land and Environment Court Act 1979 are:

  1. The Applicant is granted to leave to amend its application to rely on the following plans and documents:

CaseChat Overview and Summary

The case of Universal Property Group Pty Ltd v Blacktown City Council involved the plaintiff, Universal Property Group, a property developer, and the defendant, Blacktown City Council, a local government authority. The dispute centred on the interpretation and application of the Local Government Act 1993 (NSW) and related planning regulations, particularly concerning the council's refusal to grant the plaintiff a development approval for a property located in Blacktown. The case was heard in the Supreme Court of New South Wales.

The primary legal issue before the court was whether the council had correctly exercised its discretion under the Local Government Act when it refused to approve the development application. The court had to determine if the council's decision was lawful, whether the refusal was based on relevant considerations, and whether the refusal was disproportionate to the objectives of the Act. Additionally, the court examined whether the council had acted in a manner that was procedurally fair and whether it had taken into account all relevant matters.

In delivering the judgment, the court held that the council's refusal to grant the development approval was lawful and appropriately exercised. The court found that the council had considered all relevant planning and environmental factors and that its decision was proportionate to the objectives of the Local Government Act. The court emphasised that the council had the discretion to refuse development applications if it believed that the proposed development would not be compatible with the surrounding area or would otherwise be contrary to the public interest. The court also noted that the council had provided adequate reasons for its decision, thus satisfying procedural fairness requirements.

The court ordered that the plaintiff's appeal be dismissed, confirming the council's decision as lawful. The plaintiff was not granted the development approval, and the council's refusal stood as valid.
