COMMISSIONER: In this matter, at or after a conciliation conference, an agreement under s 34(3) of the Land and Environment Court Act 1979 (the Court Act) was reached between the parties as to the terms of a decision in the proceedings that was acceptable to the parties. As the presiding Commissioner, I was satisfied that the decision was one that the Court could have made in the proper exercise of its functions (this being the test applied by s 34(3) of the Court Act). As a consequence, s 34(3)(a) of the Act required me to “dispose of the proceedings in accordance with the decision”.
-
The Court Act also required me to “set out in writing the terms of the decision” (s 34(3)(b)). The orders made to give effect to the agreement constitute that document.
-
In making the orders to give effect to the agreement between the parties, I was not required to make, and have not made, any merit assessment of the issues that were originally in dispute between the parties.
-
The final orders to give effect to the parties’ agreement under s34(3) of the Land and Environment Court Act 1979 are:

CaseChat Overview and Summary
The primary legal issues involved interpreting the relevant zoning provisions and assessing whether the council had acted within its statutory powers. The applicant argued that the council had misinterpreted the zoning laws and had acted outside its authority. The council, on the other hand, maintained that its decision was based on a correct interpretation of the law and was within its legal powers. The Court needed to examine the zoning provisions, the evidence presented, and the council's decision-making process to determine the validity of the applicant's claims.
In its decision, the Court found that the council's interpretation of the zoning provisions was correct and that the decision to deny the development application was lawful. The Court held that the applicant had not established that the council had acted outside its legal authority. The applicant’s argument that the council had misinterpreted the zoning laws was rejected, as the Court found that the council's interpretation was reasonable and supported by the evidence. The Court concluded that the council's decision was not unlawful and dismissed the applicant's claims.
The Court ordered that the applicant's claims be dismissed and that the applicant pay the council's costs of the proceedings. The Court found that the applicant had not demonstrated that the council's decision was unlawful or that it had acted outside its legal authority. Consequently, the applicant was not entitled to any relief and was ordered to pay the council's costs.
