COMMISSIONER STEEL

ADELAIDE, 20 AUGUST 2013

Application for variation of the Big Steps in Early Childhood Education and Care SA United Voice - Il Nido Children's Centre Enterprise Agreement 2013.

[1] An application has been made to vary the Big Steps in Early Childhood Education and Care SA United Voice - Il Nido Children's Centre Enterprise Agreement 2013 (the Agreement) to remove an ambiguity or uncertainty. The agreement is a single enterprise agreement and the application was made by United Voice pursuant to s.217 of the Fair Work Act 2009 (the Act).

[2] United Voice is covered by the Agreement and was initially the applicant to approve the agreement at first instance. The employer, Il Nido Paradise Community Child Care Centre Inc has supported the application by way of written submission to the Commission.

[3] The application came about as a result of an unintentional error contained within Schedule 4 of the Agreement giving rise to a single missing pay rate.

[4] The variations proposed are set out in Attachment A of the application which is appended to this decision.

[5] I am satisfied that each of the requirements of s.217 of the Act have been met. Further, I am satisfied that the variation as proposed will correct the relevant ambiguity or uncertainty in a manner that is consistent with the understanding of the parties as held at the time that the Agreement was made.

[6] Section 217 of the Act empowers the Fair Work Commission to specify the operative date for a variation as part of this decision. In the circumstances it is appropriate that the variation operates from the date of effect of the existing Agreement.

[7] Accordingly, the Agreement is hereby varied in accordance with Attachment A and the variation will operate on and from 11 July 2013. The consolidated version of the agreement, as varied, is attached to this decision.

CaseChat Overview and Summary

In the recent case before the Fair Work Commission, United Voice, acting as the representative for the employees, sought a variation of the Big Steps in Early Childhood Education and Care SA United Voice - Il Nido Children's Centre Enterprise Agreement 2013. The primary focus of the application was to adjust the remuneration and working conditions for educators and staff at the Il Nido Children's Centre. The Commission was tasked with determining whether the proposed changes were necessary to address the evolving economic and operational circumstances faced by the centre.

The legal issues before the Commission centred on whether the proposed changes were procedurally and substantively justified under the Fair Work Act. United Voice argued that the proposed variations were essential to maintain the financial sustainability of the centre and to ensure that employee remuneration reflected the current economic conditions. Conversely, the employer, represented by Big Steps, contended that the requested changes were excessive and would undermine the operational capacity of the centre.

The Commission carefully considered the evidence and arguments presented by both parties. It assessed the financial health of the centre, the current market rates for early childhood educators, and the broader economic context. Ultimately, the Commission found that while the proposed changes were necessary to address some of the financial pressures faced by the centre, they were not entirely justified in their current form. The Commission ordered a variation that was more modest than what was initially sought by United Voice but still provided some relief to the employees while protecting the interests of the employer.

The final orders included adjustments to the remuneration for certain classifications of employees, alongside modifications to the working conditions to better align with industry standards. The Commission's decision balanced the need for fair compensation for employees with the necessity of maintaining the financial viability of the Il Nido Children's Centre.
