The failure to provide a specific helicopter, in the circumstances, was not considered a fundamental breach that went to the root of the contract.

Consequently, the High Court set aside the orders of the Full Federal Court and remitted the matter to the Federal Court of Australia for further consideration of the relief to be granted.
