The Tribunal reasoned that the applicant's nominator, V & B Holdings Pty Ltd, had applied to have the position of Cook approved with the applicant as nominee on 11 May 2016. Although this nomination was initially refused on 13 March 2018, V & B Holdings Pty Ltd sought review. On 1 June 2020, the Tribunal set aside the Department's refusal and substituted a decision approving the nomination. Consequently, the Tribunal concluded that clause 187.233 was satisfied.

Given that clause 187.233 was met, the Tribunal remitted the visa application to the Minister for reconsideration of the remaining visa criteria. The Tribunal directed that the applicant meets criterion 187.233(3) of Schedule 2 to the Regulations.
