In the matter of *Turner & Turner*, the applicant, Ms Turner, sought a decree of nullity of marriage against Mr Turner. The application was heard by Johnston JR.

The court was required to determine whether the applicant was an Australian citizen and whether the grounds for a decree of nullity of marriage had been established.

Johnston JR was satisfied that the applicant met the citizenship requirement and that the grounds for nullity were established. The court applied the relevant provisions of the *Marriage Act 1961* (Cth) to reach this conclusion.

Consequently, the marriage solemnised in September 1996 between Mr and Ms Turner was declared absolutely null and void. The court also directed that a copy of the file be forwarded to the Secretary of the Attorney-General's Department.
