The court was not satisfied that the husband had the legal or physical capacity to return the vehicle to the wife, particularly given the complex and unclear assignment of the lease and the husband's company entering liquidation. Consequently, the wife's primary application for the return of the car was dismissed. However, the court was satisfied that an order for a partial distribution of property funds was warranted to enable the wife to acquire a replacement vehicle, given the husband's lack of evidence regarding his financial contributions and the need for the wife to have transport.

The court ordered that the trustees of a trust fund holding proceeds from the sale of a property were to pay $20,000 to the wife for the purchase of a motor vehicle. This sum was to be taken into account at trial. The husband's application for a similar distribution of funds was dismissed due to insufficient evidence and lack of concession from the wife. All other extant applications for final orders were adjourned to a date to be fixed for determination at trial.
