Trust Bank Sale Act 1999 (TAS)

This case involved the application of the Trust Bank Sale Act 1999 (TAS) ("the Act"). The Act authorised the sale of the business of the Trust Bank, and the integration of the bank and the purchaser, being State Bank of New South Wales Limited. The case involved an issue as to whether the court had jurisdiction to hear a dispute between the purchaser and the Tasmanian Development Agency. The purchaser argued that the court did not have jurisdiction to hear the dispute, as it was not a dispute between the purchaser and "any other person" within the meaning of section 44 of the Act. The court held that the Tasmanian Development Agency was not "any other person" for the purposes of section 44 of the Act. Accordingly, the court had jurisdiction to hear the dispute.
