CaseChat Overview and Summary

The matter before the Fair Work Commission was an application for the approval of the Trident Services Security Pty Ltd and Transport Workers' Union (Darwin International and Alice Springs Airports) Aviation Protection Officers Enterprise Agreement 2025. The application was brought by the union on behalf of its members employed as aviation protection officers by Trident Security Services Pty Ltd. The primary issue was whether the agreement met the requirements of the Fair Work Act 2009, including provisions relating to minimum entitlements, the process for making the agreement, and whether it was in the best interests of the employees it sought to cover.

The Commission considered whether the agreement provided for terms and conditions that were no less favourable than the applicable minimum standards. The union argued that the agreement was fair and reasonable, considering the nature of the work and the specific needs of the aviation protection officers. The employer, Trident Security Services Pty Ltd, did not oppose the application but highlighted certain provisions that merited close scrutiny to ensure compliance with the Act. The union provided evidence that the agreement had been appropriately negotiated and that the employees had been adequately consulted. The Commission was satisfied that the agreement complied with all legislative requirements, including the procedural fairness in its creation, and was in the best interests of the employees.

Accordingly, the Fair Work Commission approved the enterprise agreement. The decision was based on the union's demonstration that the agreement provided terms and conditions meeting or exceeding the minimum standards, and that the process of its negotiation was fair and transparent. The Commission found no grounds to reject the application and, therefore, authorised the agreement to be registered.
