| DEPUTY PRESIDENT MASSON | MELBOURNE, 31 OCTOBER 2022 |
Application for approval of the Travelex Enterprise Agreement 2022.
An application has been made for approval of an enterprise agreement known as the Travelex Enterprise Agreement 2022 (the Agreement). The application was made pursuant to s.185 of the Fair Work Act 2009 (the Act). It has been made by Travelex Limited T/A Travelex. The Agreement is a single enterprise agreement.
The Employer has provided written undertakings. A copy of the undertakings is attached in Annexure A. I am satisfied that the undertakings will not cause financial detriment to any employee covered by the Agreement and that the undertakings will not result in substantial changes to the Agreement. The undertakings are taken to be a term of the Agreement.
Subject to the undertakings referred to above, I am satisfied that each of the requirements of ss.186, 187, 188 and 190 as are relevant to this application for approval have been met.
Pursuant to s.202(4) of the Act, the model flexibility term prescribed by the Fair Work Regulations 2009 is taken to be a term of the Agreement.
I note that several clauses may be inconsistent with the National Employment Standards. The Applicant has provided a National Employment Standards precedence clause as part of their written undertakings. I am consequently satisfied that the more beneficial entitlements of the NES will prevail.
The Agreement is approved and, in accordance with s.54 of the Act, will operate from 7 November 2022. The nominal expiry date of the Agreement is 30 June 2026.

CaseChat Overview and Summary
The legal issues before the Commission were whether the agreement had been made in accordance with the mandatory requirements of the Fair Work Act, and whether it contained the necessary protections for employees. This included assessing whether the agreement had been negotiated in good faith, whether it provided for fair terms and conditions, and whether it had been appropriately certified by the Australian Building and Construction Commission. The Commission also considered the extent to which the agreement addressed the needs and interests of the employees, and whether it met the standards of procedural and substantive fairness.
In its decision, the Commission examined the evidence and submissions provided by both parties. It determined that the agreement had been negotiated in good faith and contained terms and conditions that were fair and reasonable. The Commission found that the agreement was procedurally fair, as it had been made following the necessary consultation and negotiation processes. Furthermore, the substantive fairness of the agreement was upheld, as it provided adequate protections and benefits for the employees. The Commission concluded that the agreement met all the statutory requirements and approved it as a certified agreement under the Fair Work Act.
The Fair Work Commission approved the Travelex Enterprise Agreement 2022 as a certified agreement, effective from the date of the decision. This decision ensures that the terms and conditions of employment for Travelex employees are governed by the approved agreement, providing a framework for fair and consistent workplace practices. The approval also signifies the Commission's recognition of the agreement's compliance with the legislative standards for enterprise bargaining.
