The RRT's approach appeared to focus on whether the applicants themselves were members of a political organisation, rather than whether they were perceived by the persecuting authorities as being associated with such an organisation, which is a crucial element in establishing membership of a particular social group. The Court reiterated the principle that a "particular social group" can be defined by a characteristic that is immutable or fundamental to identity, or by a characteristic that is so fundamental to an individual's identity that they should not be compelled to shed it.

The High Court ordered that the decision of the Refugee Review Tribunal be quashed and remitted to the Tribunal for redetermination according to law.
