The Administrative Appeals Tribunal considered an application for a Visitor (Class FA) visa, Subclass 600, made by a 31-year-old woman residing in Vietnam. The applicant's sister, who resides in Australia with her husband and two children, invited her to visit. The dispute centred on whether the applicant genuinely intended to stay temporarily in Australia for the purpose of her visit, as required by clause 600.211 of the Migration Regulations.

The Tribunal was required to determine if the applicant met the genuine temporary entrant requirement. This involved assessing whether she had complied substantially with the conditions of any previous substantive visa (though she had not held an Australian visa before), whether she intended to comply with the conditions of the Subclass 600 visa, and any other relevant matters. The Tribunal also considered the applicant's ties to Vietnam, including her employment of 12 years with a shoe manufacturing company, her mother, and eight siblings residing there, as well as her previous compliant visits to South Korea, Taiwan, and Malaysia.

The Tribunal found the applicant's brother-in-law to be a credible witness, affording his evidence significant weight. It noted that the applicant's purpose for visiting – to see her sister and family – was consistent with the Tourist stream of the visa. While the applicant had no prior Australian visa history, the Tribunal considered her strong employment and familial ties to Vietnam, alongside her previous international travel history, as factors weighing in favour of her genuine temporary entrant status. The Tribunal concluded that the matter should be remitted for reconsideration, with a direction that the applicant meets the criteria under clause 600.211. The Tribunal also recommended a visa validity period of three months and the application of Condition 8503.
