Touseef (Migration)

The Administrative Appeals Tribunal (AAT) considered the application of Mr. Touseef for a Student (Temporary) (Class TU) visa, subclass 500. The core of the dispute concerned whether Mr. Touseef met the 'genuine temporary entrant' (GTE) requirement for the visa. The delegate of the Minister had refused the visa application, a decision Mr. Touseef sought to have reviewed by the AAT.

The AAT was required to determine whether Mr. Touseef genuinely intended to stay in Australia temporarily for the purpose of study and whether he intended to depart Australia at the end of his authorised stay. This involved assessing the credibility of his stated intentions and the coherence of his proposed study plan in light of his previous academic history and career aspirations.

In reaching its decision, the Tribunal found that Mr. Touseef's evidence was vague, evasive, and contradictory. Specifically, the Tribunal noted that he had completed multiple courses, including studies in a field unrelated to and at a lower level than his previous studies. The Tribunal was not satisfied that his proposed course of study represented a genuine career path for him, nor that his academic progress was satisfactory. Consequently, the Tribunal affirmed the delegate's decision to refuse the visa.
