TMVJ and National Disability Insurance Agency

The Administrative Appeals Tribunal considered an application by TMVJ for access to the National Disability Insurance Scheme, which was opposed by the National Disability Insurance Agency. The core of the dispute concerned whether TMVJ met the legislative requirements for scheme access, specifically the disability and early intervention criteria.

The Tribunal was tasked with determining whether TMVJ's impairments were permanent, or likely to be permanent, as required by section 24 of the National Disability Insurance Scheme Act 2013 (Cth). Additionally, the Tribunal had to assess whether TMVJ met the early intervention requirements under section 25 of the Act.

Senior Member Buxton found that TMVJ did not satisfy the access criteria outlined in sections 24 and 25 of the Act. Consequently, the Tribunal affirmed the decision under review, as permitted by paragraph 43(1)(a) of the Administrative Appeals Tribunal Act 1975 (Cth).
