Thomson and Thomson (No 2)

In *Thomson and Thomson (No 2)*, Burr J of the Family Court of Australia considered an application for costs made by the wife. The dispute concerned the wife's entitlement to party/party costs following proceedings between the parties.

The central legal issue before the court was the quantum and basis of the wife's entitlement to her legal costs. Specifically, the court was required to determine the period for which costs should be awarded and the applicable scale for taxation.

Burr J ordered that the husband pay the wife's party/party costs. These costs were to be calculated based on the relevant scale under the Family Law Rules, commencing from 18 June 2008 and continuing up to and including the date of the costs application. The total amount was to be taxed or agreed between the parties and paid by the husband within thirty days of taxation or agreement.
