CaseChat Overview and Summary
The main legal issues the Commission needed to address were whether the agreement met the requirements of sections 186, 187 and 188 of the Fair Work Act, which set out the criteria for an agreement to be approved. The Commission also needed to consider whether the Australian Workers' Union, a bargaining representative for the agreement, had opted in for the agreement to cover it. The Commission found that the agreement met all the relevant requirements and that the union had opted in for the agreement to cover it.
Based on its findings, the Commission approved the agreement, which will operate from 25 February 2016 until 31 December 2018. The approval was in accordance with section 54 of the Fair Work Act. The Commission was satisfied that the agreement met all the necessary criteria and that the parties had followed the correct procedures in making the agreement.
