CaseChat Overview and Summary

The Trustee For Rolls Printing Unit Trust T/A Rolls Australia recently applied to the Fair Work Commission for approval of the Rolls Printing Pty Ltd Workplace Agreement 2017. The dispute arose from the proposed changes to employee working conditions and the classification of certain roles within the company. The application was heard in the Fair Work Commission, which has jurisdiction to approve workplace agreements under the Fair Work Act 2009.

The primary legal issue before the Commission was whether the proposed changes in the workplace agreement met the requirements for approval under the Fair Work Act. Specifically, the Commission had to determine if the agreement provided for terms and conditions that were no worse off overall than the applicable award or registered agreement, and whether it complied with the good faith bargaining provisions. The Commission also needed to consider if the changes to employee roles and conditions were fair and reasonable, and if the agreement included appropriate mechanisms for resolving disputes.

In assessing the application, the Commission examined the evidence provided by both the applicant and the union representing the employees. The Commission considered the potential impact of the changes on employees' working conditions and the overall fairness of the agreement. After reviewing the evidence and submissions, the Commission found that the proposed changes did not result in employees being worse off overall and that the agreement complied with the good faith bargaining requirements. The Commission also determined that the changes to roles and conditions were fair and reasonable, and that the agreement included adequate dispute resolution mechanisms.

The Commission approved the Rolls Printing Pty Ltd Workplace Agreement 2017, subject to certain conditions. The final orders included a requirement for the applicant to provide additional information to employees regarding the changes and to implement a consultation process to address any concerns or issues that may arise from the agreement.
