CaseChat Overview and Summary

The Administrative Appeals Tribunal reviewed a decision concerning the approval of a nomination for a position under the Direct Entry stream of the Regional Sponsored Migration Scheme. The parties involved were the Trustee for Neumann Family Trust, acting as the nominator, and the Department of Home Affairs (implied). The dispute centred on whether the nominator met the requirements for approving the nomination, particularly in light of adverse information that had been raised.

The Tribunal was required to determine if the applicant satisfied the general requirements for nomination approval under reg 5.19(4) of the Migration Regulations 1994, as well as the specific requirements for the Direct Entry stream under reg 5.19(9). Key issues included whether the application was made in the prescribed form, whether there was any adverse information about the nominator or associated persons that could not be disregarded, whether the nominator was actively and lawfully operating a business, and whether there was a genuine need for the nominated position and the nominee's employment.

The Tribunal reasoned that while adverse information had been disclosed concerning allegations of payment for sponsorship and issues with the applicant's former representative, the evidence provided by the applicant upon review sufficiently addressed these concerns. The applicant submitted payroll summaries, bank statements, and audit reports that did not corroborate the allegations. Furthermore, the applicant's former representative was no longer acting for them, and there was no evidence of ongoing investigation or findings against the applicant or nominee. The Tribunal found that the applicant had provided numerous letters of support from employees, customers, and suppliers, and that the applicant was a long-established business with a reputation to uphold. Consequently, the Tribunal was satisfied that there was no adverse information that could not be disregarded and that the applicant met all other relevant regulatory requirements, including actively and lawfully operating a business and demonstrating a genuine need for the position.

The Tribunal set aside the original decision and substituted a new decision approving the nomination.
