The State of Western Australia applied to the Supreme Court of Western Australia for an order under s 55 of the High Risk Serious Offenders Act 2020 (WA) (HRSO Act) that the supervision order made in respect of the respondent, Edward William Latimer, be rescinded and a continuing detention order be made in relation to the respondent. In the alternative, the State sought amendment of the Supervision Order. The application was made following four alleged contraventions of the Supervision Order by the respondent. The court found that the respondent had contravened the Supervision Order on four occasions. The court found that the supervision order could be amended in such a manner that the community would be adequately protected against the unacceptable risk that, if not subject to restriction, the respondent would commit a serious offence. The court found that, having regard to the amended conditions, the respondent would substantially comply with the standard conditions of the amended supervision order. The court ordered that the Supervision Order be amended and the respondent released on the amended supervision order.
