The Police Federation of Australia (Victoria Police Branch) v Victoria Police

The Police Federation of Australia (Victoria Police Branch) has appealed against a decision made by Deputy President Colman at Melbourne on 1 March 2021 in matter number C2020/6810. The respondent to the appeal is Victoria Police. The dispute between the parties concerns the interpretation and application of the Police Officers (Victoria Police) Enterprise Agreement 2018. The Federal Court of Australia was required to determine whether the Federal Circuit Court had correctly interpreted the terms of the enterprise agreement in relation to the classification of certain police officers.

The central legal issue in this case was the correct interpretation of the classification provisions within the Police Officers (Victoria Police) Enterprise Agreement 2018. Specifically, the court was tasked with determining whether the Federal Circuit Court had properly interpreted the agreement in relation to the classification of police officers who performed duties that were not specifically listed in the agreement. The Court also emphasised the importance of considering the overall purpose and objectives of the enterprise agreement in the interpretation process. As a result, the appeal was upheld, and the matter was remitted to the Federal Circuit Court for reconsideration in light of the Court's decision.

In light of the findings, the Federal Court issued orders setting aside the decision of the Federal Circuit Court and remitting the matter for further consideration. The Court directed that the rehearing be conducted in accordance with the principles set out in its judgment, ensuring that the classification of police officers is determined in a manner consistent with the proper interpretation of the Police Officers (Victoria Police) Enterprise Agreement 2018.
