CaseChat Overview and Summary
The central legal issues in the case revolved around whether the proposed agreement complied with the Fair Work Act 2009, particularly in relation to provisions concerning enterprise bargaining, employee entitlements, and the protection of health and safety. The FWC had to assess if the agreement provided fair and reasonable terms for employees while ensuring it did not pose any risks to public safety or health. The FWC also needed to determine whether the agreement appropriately balanced the interests of the employees, the employer, and the broader public.
The FWC found that the ONRSR Enterprise Agreement 2018 - 2020 met the necessary criteria for approval. The agreement provided fair and reasonable terms for the employees and contained provisions that protected the health and safety of both employees and the public. The FWC determined that the agreement appropriately balanced the interests of all parties involved. Consequently, the FWC approved the agreement, subject to the terms and conditions outlined in the decision.
The final orders of the FWC included the approval of the ONRSR Enterprise Agreement 2018 - 2020, effective from 1 March 2018 until 31 December 2020, subject to any modifications required by the FWC. The agreement was to be registered with the Australian Industrial Relations Commission, and the parties were required to comply with the terms and conditions set out in the decision.
