The Gateway at Ryde Pty Ltd v Ryde Ex-Services Memorial and Community Club Ltd

The Gateway at Ryde Pty Ltd (the applicant) sought leave from the Court of Appeal of the Supreme Court of New South Wales to appeal a decision concerning its claim against Ryde Ex-Services Memorial and Community Club Ltd (the respondent). The applicant's sole interest in the outcome of the proposed appeal was to preserve its claim for specific performance of an agreement to purchase and redevelop land from the respondent.

The primary legal issue before the Court was whether there was a sufficiently serious question to be tried in relation to the applicant's underlying claim for specific performance to justify granting leave to appeal. This required the Court to assess the prospects of success of the applicant's substantive claim.

Meagher JA considered the applicant's arguments and concluded that the underlying claim for specific performance did not raise a seriously arguable case. Consequently, the Court found no sufficient reason to grant leave to appeal. The applicant's notice of motion was dismissed with costs.
