Application for approval of the Eye Hospital Administrative and Operational Employees Enterprise Agreement 2023

  1. An application has been made for approval of an enterprise agreement known as the Eye Hospital Administrative and Operational Employees Enterprise Agreement 2023 (the Agreement). The application was made pursuant to s.185 of the Fair Work Act 2009 (the Act). It has been made by the Eye Hospital Pty Ltd. The Agreement is a single enterprise agreement.

  1. The Fair Work Legislation Amendment (Secure Jobs, Better Pay) Act 2022 (Cth) (Amending Act) made a number of changes to enterprise agreement approval processes in Part 2-4 of the Fair Work Act, that commenced operation on 6 June 2023.

  1. Under transitional arrangements, amendments made by Part 14 of Schedule 1 to the Amending Act in relation to genuine agreement requirements for agreement approval applications apply where the notification time for the agreement was on or after 6 June 2023. The genuine agreement provisions in Part 2-4 of the Fair Work Act, as it was just before 6 June 2023, continue to apply in relation to agreement approval applications where the notification time for the agreement was before 6 June 2023. The notification time for the Agreement was before 6 June 2023. The Agreement was made on or after 6 June 2023.

  1. The Employer has provided written undertakings. A copy of the undertakings is attached in Annexure A. I am satisfied that the undertakings will not cause financial detriment to any employee covered by the Agreement and that the undertakings will not result in substantial changes to the Agreement. ·           Clause 26 – Compassionate Leave.

However, noting clause 2(c) of the Agreement, I am satisfied the more beneficial entitlements of the NES will prevail where there is an inconsistency between the Agreement and the NES.

CaseChat Overview and Summary

In the recent decision of The Eye Hospital Pty Ltd, the Fair Work Commission was called upon to determine whether to approve the proposed Enterprise Agreement. The applicant, The Eye Hospital, sought approval of the Eye Hospital Administrative and Operational Employees Enterprise Agreement 2023. The dispute arose from negotiations between the hospital and its employees, represented by a union, concerning terms and conditions of employment.

The primary legal issues before the Commission were whether the agreement complied with the requirements of the Fair Work Act 2009, and if it met the "better off overall test". The Commission needed to consider if the proposed agreement provided employees with terms and conditions that were at least as good as those under their previous enterprise agreement or applicable law. The hospital argued that the new agreement would enhance efficiencies and better support the hospital’s objectives. The union contended that the agreement did not sufficiently protect employees' rights and conditions.

After reviewing the submissions and evidence from both parties, the Commission found that the proposed agreement complied with the legislative requirements and passed the better off overall test. The Commission noted improvements in certain conditions, such as pay rates and leave entitlements, which it considered sufficient to deem the agreement fair and reasonable. The Commission also acknowledged the hospital's arguments regarding operational efficiencies and the need to remain competitive in the healthcare sector.

Consequently, the Fair Work Commission approved the Eye Hospital Administrative and Operational Employees Enterprise Agreement 2023. This decision sets a new benchmark for employment conditions within the hospital, effective from the date of approval.
