The applicant sought to nominate Mr. Hilton Dean Edwards for a Subclass 186 visa.

The primary legal issue before the Tribunal was whether the applicant met all the requirements stipulated in regulation 5.19(3) of the Migration Regulations 1994 for the approval of the employer nomination. This involved assessing various criteria, including the genuineness of the position, the nominator's financial capacity, the need to employ the nominee, and the terms and conditions of employment.

The Tribunal found that the nominator, The Bible League Incorporated, a registered charity, had a genuine need to employ the nominee as a paid Marketing Manager. The Tribunal considered the organisation's specialised nature, its fundraising activities, and its ministry operations in Australia. Crucially, the Tribunal determined that it was reasonable to disregard certain aspects of regulation 5.19(3)(f)(i) concerning training requirements, indicating that the nominator had met the necessary criteria or that any non-compliance was minor and could be overlooked. The Tribunal also noted the forthright and helpful conduct of the nominator's representatives.

Consequently, the Tribunal set aside the original decision and substituted a new decision approving the employer nomination.
